A $505 million federal prison in Letcher County, Kentucky, poised to become the priciest prison in U.S. history, isn’t just dead wrong; it’s undemocratic. Worse still, Kentucky Rep. Hal Rogers inserted a toxic rider (Section 223) into the 2025 Appropriations Bill designed to silence anyone outside Eastern Kentucky who dares to challenge it. A powerful law cloaked in secrecy, this rider is a bold power grab unworthy of a democracy.

Even the Department of Justice, under both President Trump and President Biden, has recommended scrapping the funding altogether. Yet here we are, watching local opposition, including residents, corrections experts, and community advocates, being muzzled in the halls of Congress.

Why This Matters Right Now

Prison numbers are falling, while staffing shortages and deferred maintenance plague the Bureau of Prisons. Investing hundreds of millions in a brand-new prison in these conditions is reckless. Federal tax dollars underwrite the project—but the public has no say, thanks to Section 223.

That’s not democracy; it’s authoritarian bullshit.

But the Resistance Is Marching

From Eastern Kentucky to Washington, DC voices united in opposition are growing louder. Locals are demanding real community safety, investing in care, not cages. Indigenous-led groups have even purchased parcels of the slated prison land, envisioning land stewardship, not incarceration.

Groups like The Sentencing Project are calling for Congress to rescind the funding entirely, joining the DOJ’s calls to defund this project.
